Mistrial called after jurors argue, throw chairs at each other

A federal judge has declared a mistrial in the first trial over whether Merck & Co.ís osteoporosis drug, Fosamax, causes painful jaw bone destruction.

Jurors in the month-long trial in Manhattan had been saying since Monday that they couldnít reach a verdict. Deliberations deteriorated to the point that lawyers waiting in the courtroom could hear screaming coming from the jury room and one female juror said another juror threw a chair at her.
Lawyers from both sides reported hearing screams coming from the jury room.
"Oh, I'm going to punch you in the head," a female panelist from The Bronx threatened.

Finally, on Wednesday, Ciccone sent a letter to Judge John Keenan. "I need a police escort out of here -- and I am afraid to come back because I cannot in good conscience vote for a case because of threats," she wrote.

After just an hour of deliberations today, Judge John F. Keenan declared a mistrial in the case of plaintiff Shirley Boles.
The 71-year-old Fort Walton, Fla., woman alleged she developed severe dental and jaw-related problems several years after she began taking Fosamax in 1997 and now can only eat soft food.

This is what happens when no one is appointed as a "jury chairperson". No one was in charge of chairs.

This is another example of playing Musical Chairs, when the jurors are bored, on an empty stomach. The judge should have taken an "order in the court" for lunch.

This is insane. Even in a place of law, people cannot use common sense, common courtesy, and must resort to violence? It is another example of the deterioration of our society in general. I'm appalled and disgusted. Now this poor 71 year old woman has to go through another trial? I hope the judge imposed some sort of punishment on the idiot jurors who couldn't behave like adults and humans in general.
